The Challenge

In the context of labour law, employers are faced with ever-increasing challenges. We assist them in defining general working conditions, resolving labour disputes, drawing up individual employment contracts, negotiating with the works council, organising working time, protecting employees from discrimination, ensuring compliance with the employer’s duty of care, or handling data protection issues in international groups of companies.

Labour law also must be taken into consideration during company restructuring. The challenges in this context range from agreeing social plans to the integration of employees from different companies into new units.
In addition, there is a growing tendency towards more flexibility in the workplace, as shown by the increased use of leased employees. Furthermore, employee participation in company profits or pension commitments are just two possible management tools for companies to foster employee motivation and loyalty.

Our Expertise

We advise companies on labour law matters extensively, including the preparation and negotiation of employment contracts (both for ordinary employees and top executives) and the negotiation of works agreements and we represent employers in legal disputes before courts of law, as well as before conciliation boards, the Federal Equal Treatment Commission and public authorities.

We also advise on compensation plans (“social plans”) prepared in connection with the shutdown of plants and personnel reductions. We also advise formerly government-owned companies or other enterprises that have to deal with different types of employment contracts for former civil servants and other types of employees, which includes support in negotiating collective bargaining agreements.
