Epidemic Act: second chance for compensation

With the amendment of the Epidemic Act, the discussion about compensation has gained momentum again. The exclusion of the right to compensation for loss of earnings under the Epidemic Act had already led to an appeal before the Constitutional Court. While the Constitutional Court resumed its previous deliberations in July, which had dealt with com-pensation for businesses, among other things, the legislature also became active.

The amendment to the Epidemics Act now includes a second chance for compensation. For example, the deadline for asserting a claim for compensation for loss of earnings due to an official measure in connection with COVID-19 has been extended from six weeks to three months. Both current and expired periods start to run again. Those affected who have not yet submitted an application for remuneration are thus given an additional opportunity to assert their claims. The period began on 8.7.2020. Applications must be submitted to the district administrative authority in whose area the measures were taken.

However, the ordinance of the Minister of Health, which is intended to set out more detailed rules for calculating the amount of compensation or remuneration for loss of earnings, is still outstanding.
