Energy Law

The Challenge
In recent years, the liberalisation of electricity law and gas law has substantially changed the legal framework for companies conducting business in this sector. These companies have had to be restructured in order to comply with altered regulatory requirements, and their contractual relationships with their clients have also had to be adapted to the new legal situation. The need for adjustments in the energy sector is not yet over, since it is expected that further amendments will be made to the legal framework, requiring additional adaptations in this industrial sector.

Advising companies about energy law requires extremely high competence in public law and specialised knowledge of energy law, in combination with expertise in company law, reorganisation tax law and civil law. Only legal advisers with expertise in all these fields and the ability to integrate this knowledge into optimal interdisciplinary solutions can provide companies in the power supply industry with ideal solutions that meet their individual requirements.

Our Expertise
For years, fwp has been advising companies in the energy sector, among them Austria's largest energy provider. Our consultations have focused particularly on restructuring measures aimed at achieving compliance with liberalisation requirements. fwp has also been consulted in connection with alliances between power supply companies. Such consultations require expertise not only in public law, energy law, reorganisation tax law, company law and civil law, but also in the areas of public procurement and state aid as well as anti-trust law. Through the specialised knowledge of experts in all these fields, working together in interdisciplinary teams, fwp has been able to arrive at optimal solutions for each client.
