The Challenge
The legal framework for companies in the insurance sector has changed drastically in recent years. On the one hand, cross-border market access has been simplified considerably as a result of liberalisation; on the other hand there have been a number of changes in insurance supervisory law. Moreover, the reporting requirements for insurance companies with regard to the policy holders' need for information – not least due to the pressure of consumer protection organisations – have been considerably extended. The situation for both insurance companies and insurance intermediaries has also altered considerably as a result of EU directives relating to insurance intermediaries law. Finally, court rulings have given rise to new legal challenges by extending the application of commercial agent law to insurance intermediar-ies.

Advising insurance companies requires particularly high competence in insurance supervisory law, public law and private insurance law, coupled with expertise in commercial law and civil law. Only specialised knowledge in all of these legal fields and the ability to apply this knowledge in an interdisciplinary fashion can ensure the capacity to provide comprehensive legal advice for companies in this sector.
