Pension Law, Pension Funds

The Challenge
The third pillar of retirement provision, the company pension, is steadily gaining importance. The prospect of a specially tailored company pension at retirement age increases the attractiveness of any job offer in the labour market. However, due to the inherent long-term obligations for companies, the offer of a company pension demands meticulous preparation and formulation of its legal basis. A company confronted with serious changes in the economic situation must be in a position to free itself from (future) obligations, while employees must be made as secure as possible against the loss of acquired claims. Optimal solutions can only be achieved through the interplay of expertise in pension law, labour law, tax law and commercial law.

Our Expertise
fwp advises employers in the implementation of company pension commitments, be they direct benefit commitments or pension fund solutions backed by employer's pension liability insurance. Our consulting services include the preparation and negotiation of company agreements as well as agreements with pension funds. The transfer of employers’ pension commitments, including protection of the transferring company against liability for supplementary claims, is part of the spectrum of these consulting services, as is the enforcement of the reduction or discontinuation of employers' obligations arising out of exces-sive pension commitments.
