The Challenge
From the macroeconomic perspective, public contracts are of tremendous importance. Particularly in an economy with a strong public sector, which is still the case in Austria, this field is of great significance to our clients: public authorities, as the awarders of public contracts, and private companies striving to obtain such contracts. In contrast to private enterprises, contracting authorities have to act in compliance with a legally stipulated, formalised contract award procedure. Under public procurement law, both public contract awarders as well as ten-derers have to meet exacting requirements. Due to the formalised procedure, public procure-ment tends to require a considerable amount of time; formal defects can result in added ex-penses which would be avoidable if all formal provisions were complied with in time. EU law has had a particular impact on the development of Austrian procurement law and this is of central significance for tenderers as well as public authorities, both of which we number among our clients.
Our Expertise
