On 15 and 16 October 2009, all relevant developments and news will be presented at the annual get-together of lawyers and tax experts. Also the current economic situation will be discussed at the event, which is hosted by Business Circle. Dr. Markus Fellner will make a presentation on nonperforming loan transactions with a special focus on the assignment of collateral.
The workshop, which Dr. Fellner will hold together with Univ.-Prof. Dr. Brigitta Jud, will cover the following issues:
• Overview of NPL (nonperforming loan) transactions
• Principles and restrictions on the sale of loans under civil and banking law: Austrian Civil Code, Austrian Consumer Protection Act / banking secrecy and data secrecy
• True sale: trust design
• Acquisition of collateral (liens, assignments, guarantees, surety ships)
• Mortgage loans: assignment of claims / mortgages for specific amounts vs. maximum amount mortgages / participation of the debtor?
• NPL transaction structure / contract drafting
